Terms of Service

These Terms of Service (“Terms”) govern your use of nana AI (the “Service”), provided by team.DRN (“Company”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Service.

1. Description of the Service

nana AI is an application that allows users to upload images and generate or edit images using AI-powered features. The Service is provided without requiring user registration and operates using an anonymous user identifier (UUID).

Users acknowledge that the Service relies on artificial intelligence technologies, which may generate unexpected, inaccurate, unrealistic, or unintended results.

2. Eligibility

You must comply with all applicable laws and App Store policies to use the Service. If you are under the age required by applicable law to use the Service, you must obtain permission from a parent or legal guardian.

3. User Accounts

• The Service does not require account creation or login.
• The Company manages service usage using an anonymous UUID generated on the user’s device.
• Users are responsible for maintaining access to their device and app environment.

4. User Content

4.1 Ownership

• Users retain all rights to the images they upload to the Service.
• Users also retain rights to images generated through the Service, subject to applicable laws and these Terms.

4.2 License to Operate the Service

By uploading content, users grant the Company a limited, non-exclusive, non-transferable license to process the content solely for the purpose of providing the Service.

The Company does not use user content for advertising or marketing purposes and does not claim ownership of user content.

4.3 Rights and Permissions

Users represent and warrant that they have all necessary rights, consents, and permissions to upload, process, and generate images using the Service, including images that may contain other individuals.

5. Prohibited Use

Users agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property, privacy, publicity, or other rights of others
• Upload or generate illegal, harmful, hateful, or offensive content
• Upload or generate content involving minors in a sexualized, exploitative, or inappropriate manner
• Attempt to reverse engineer, disrupt, or abuse the Service
• Circumvent usage limits, token systems, subscription rules, or payment mechanisms

The Company reserves the right to restrict or suspend access in case of misuse.

6. In-App Purchases and Subscriptions

• The Service may offer in-app purchases or subscriptions through the Apple App Store.
• All payments are processed by Apple in accordance with Apple’s terms and policies.
• Prices, billing cycles, renewal terms, and subscription details are displayed at the time of purchase.
• The Company does not have the ability to issue refunds or modify purchases made through the Apple App Store. Refund requests must be handled directly through Apple.

6.1 Subscription Usage Policy

Paid subscribers may generate images without a fixed total limit.

However, if image generation exceeds a certain daily threshold, the quality, speed, or priority of image generation may be temporarily reduced.

This daily threshold is based on a calendar day and is automatically reset each day.

7. Service Availability

• The Company strives to provide a stable Service but does not guarantee uninterrupted or error-free operation.
• The Service may be modified, suspended, or discontinued at any time without prior notice.

8. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis.

The Company makes no warranties, express or implied, regarding the accuracy, reliability, quality, or suitability of AI-generated content.

Users acknowledge that AI-generated images may produce unexpected or undesirable outcomes, and agree that any use of generated content is solely at their own risk and responsibility.

9. Limitation of Liability

To the maximum extent permitted by law:

• The Company shall not be liable for any indirect, incidental, or consequential damages
• The Company is not responsible for losses arising from user-uploaded or AI-generated content
• Total liability shall not exceed the amount paid by the user for the Service, if any

10. Indemnification

Users agree to indemnify and hold harmless the Company from any claims, damages, losses, or expenses arising from misuse of the Service or violation of these Terms.

11. Termination

• Users may stop using the Service at any time by uninstalling the app.
• The Company may restrict or suspend access to the Service if these Terms are violated.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, unless otherwise required by applicable law.

Nothing in these Terms shall affect any mandatory consumer rights under applicable local laws.

13. Changes to These Terms

The Company may update these Terms from time to time. Continued use of the Service after changes indicates acceptance of the updated Terms.

利用規約

本利用規約（以下「本規約」）は、team.DRN（以下「当社」）が提供する nana AI（以下「本サービス」）の利用条件を定めるものです。

ユーザーは、本サービスを利用することにより、本規約に同意したものとみなされます。本規約に同意しない場合は、本サービスの利用を中止してください。

1. サービス内容

nana AI は、ユーザーが画像をアップロードし、人工知能（AI）技術を用いて画像を生成または編集できるアプリケーションです。

本サービスは、ユーザー登録を必要とせず、ユーザーの端末上で生成される匿名のユーザー識別子（UUID）を用いて提供されます。

ユーザーは、本サービスが人工知能技術に基づいており、予期しない、不正確な、または意図しない結果を生成する可能性があることを理解し、これに同意します。

2. 利用資格

ユーザーは、本サービスの利用にあたり、適用されるすべての法令および App Store のポリシーを遵守するものとします。

適用法令により定められた年齢に満たない場合、親権者または法定代理人の同意を得た上で本サービスを利用してください。

3. ユーザーアカウント

本サービスの利用にあたり、アカウントの作成やログインは必要ありません。

当社は、ユーザーの端末で生成される匿名 UUID を用いてサービス利用状況を管理します。

ユーザーは、自身の端末およびアプリ利用環境を適切に管理する責任を負います。

4. ユーザーコンテンツ

4.1 権利の帰属

ユーザーが本サービスにアップロードした画像の権利は、ユーザーに帰属します。

また、本サービスを通じて生成された画像の権利も、適用される法令および本規約に従い、ユーザーに帰属します。

4.2 サービス提供のための利用許諾

ユーザーは、コンテンツをアップロードすることにより、本サービスの提供目的に限り、当社が当該コンテンツを処理するための、非独占的かつ譲渡不可の利用権を当社に許諾するものとします。

当社は、ユーザーコンテンツを広告またはマーケティング目的で使用せず、また、コンテンツの所有権を主張しません。

4.3 権利および同意の保証

ユーザーは、本サービスにアップロードまたは生成するすべての画像について、必要な権利、同意および許可を適法に取得していることを保証するものとします。これには、第三者の肖像、画像、個人情報が含まれる場合も含まれます。

5. 禁止事項

ユーザーは、以下の行為を行ってはなりません。

• 法令または規則に違反する行為
• 第三者の知的財産権、肖像権、プライバシーその他の権利を侵害する行為
• 違法、有害、差別的、または不快なコンテンツをアップロードまたは生成する行為
• 未成年者を性的、搾取的、または不適切に描写するコンテンツをアップロードまたは生成する行為
• 本サービスを逆解析、妨害、または不正に利用する行為
• 利用制限、トークンシステム、サブスクリプションまたは決済仕組みを回避しようとする行為

当社は、上記行為が確認された場合、事前の通知なく本サービスの利用を制限または停止することがあります。

6. アプリ内課金およびサブスクリプション

本サービスでは、Apple App Store を通じてアプリ内課金またはサブスクリプションを提供する場合があります。

すべての支払いは、Apple の規約およびポリシーに従って処理されます。価格、請求周期、自動更新条件などは、購入時に表示されます。

当社は、App Store を通じて行われた購入について、返金や変更を行う権限を有しておらず、返金に関する手続きは Apple にて行われるものとします。

6.1 サブスクリプション利用ポリシー

有料サブスクリプションユーザーは、画像生成回数に関して総量の上限なく本サービスを利用できます。

ただし、1日あたりの一定回数を超えて画像生成を行った場合、画像生成の品質、処理速度、または優先度が一時的に制限されることがあります。

この1日の基準は日付単位で計算され、毎日自動的にリセットされます。

7. サービスの提供中断

当社は、安定したサービス提供に努めますが、本サービスが常に中断なく、またはエラーなく提供されることを保証するものではありません。

当社は、必要に応じて、事前の通知なく本サービスの全部または一部を変更、中断、または終了することがあります。

8. 保証の否認

本サービスは、「現状有姿（as is）」および「提供可能な状態（as available）」で提供されます。

当社は、AI により生成されたコンテンツの正確性、信頼性、品質、または特定目的への適合性について、いかなる保証も行いません。

ユーザーは、AI による生成結果が予期しない、または望ましくない内容となる可能性があることを理解し、その利用に関する責任はすべてユーザー自身に帰属することに同意します。

9. 責任の制限

適用法令で許容される最大限の範囲において、

• 当社は、間接的、付随的、結果的な損害について責任を負いません。
• ユーザーコンテンツまたは AI 生成コンテンツに起因する損害について、当社は責任を負いません。
• 当社の責任総額は、当該ユーザーが本サービスに対して支払った金額を上限とします。

10. 免責および補償

ユーザーは、本規約に違反したこと、または本サービスを不正に利用したことにより生じたすべての請求、損害、費用について、当社を免責し、補償するものとします。

11. 利用終了

ユーザーは、アプリをアンインストールすることにより、いつでも本サービスの利用を終了できます。

当社は、ユーザーが本規約に違反した場合、本サービスの利用を制限または停止することがあります。

12. 準拠法

本規約は、大韓民国の法律に準拠し、解釈されるものとします。

本規約のいかなる規定も、適用される法令に基づくユーザーの強行的な権利を制限するものではありません。

13. 規約の変更

当社は、必要に応じて本規約を変更することがあります。

変更後も本サービスを継続して利用した場合、当該変更に同意したものとみなされます。
